These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with the Survival Insights website, app, email list and other services (the “Service” or “SURVIVAL INSIGHTS”) operated by Survivable, LLC (“us”, “we”, or “our” or “SURVIVABLE”).

Please read these Terms and Conditions carefully before using the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

You further acknowledge and agree that SURVIVABLE shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

SURVIVABLE its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

These Terms shall be governed and construed in accordance with the laws of Idaho, in the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, it is your responsibility to stop using the Service.

In the event that a dispute arises the parties agree that such dispute will be subject to final and binding arbitration with jurisdiction and venue in Madison County, Idaho, USA, to be presented in front of a single arbitrator chosen by the parties. The parties acknowledge and agree that they are waiving their right to file a lawsuit in connection with this matter, in favor of binding arbitration. Should the arbitrator’s award be found to be judicially reviewable, further review is subject to the exclusive jurisdiction of the state courts of Idaho with venue in Madison County, Idaho. The losing party in such arbitration will be required to pay the winning party’s legal fees and costs

Failure of SURVIVABLE to enforce a right under this Agreement will not act as a waiver of that right or the ability to later assert that right relative to the particular situation involved.

If any part of this agreement is for any reason found to be unenforceable, all other parts remain enforceable.
